Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the Pundit iOS application and website at punditapp.uk (collectively, the "Service"), operated by Pundit ("we", "us", or "our"). By creating an account or using the Service, you confirm that you are at least 13 years of age and agree to be bound by these Terms.

2. Description of Service

Pundit is a sports prediction game. Users can create or join private leagues, submit predictions on sports match outcomes, and compete for points on a leaderboard. The Service is for entertainment purposes only. Pundit is not a gambling or real-money wagering platform. No real money can be won or lost through predictions made in the app.

3. Account Registration

To use Pundit you must create an account using a valid email address and a username. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@punditapp.uk if you suspect any unauthorised use of your account.

You may not create an account on behalf of another person without their permission, or use a username that impersonates any person or entity.

4. Pundit Pro — Subscription

Pundit Pro is an auto-renewable subscription that unlocks premium features including unlimited leagues, live score updates, and advanced statistics. Subscription fees are non-refundable except as required by applicable law or Apple's refund policy. You will not receive a refund for any unused portion of a subscription period.

If you cancel your subscription, you will retain access to Pro features until the end of the current billing period, after which your account will revert to the free tier.

We reserve the right to change the price of Pundit Pro. We will give you reasonable notice of any price change. Continued use of the subscription after the price change takes effect constitutes your acceptance of the new price.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Harass, abuse, or harm other users.
• Submit false, misleading, or offensive content.
• Attempt to gain unauthorised access to any part of the Service or another user's account.
• Use automated scripts, bots, or scraping tools to access the Service.
• Reverse engineer, decompile, or disassemble any part of the app.
• Use the Service for any commercial purpose without our prior written consent.

6. User Content

You retain ownership of any content you submit to the Service, including your username and predictions. By submitting content, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content solely for the purpose of operating and improving the Service.

You are solely responsible for any content you submit. We do not endorse any user content and reserve the right to remove any content that violates these Terms or that we deem inappropriate.

7. Intellectual Property

All content, design, code, trademarks, and other intellectual property in the Service (excluding user content) are owned by or licensed to Pundit. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written permission.

The Pundit name, logo, and app icon are trademarks of Pundit. Nothing in these Terms grants you any right to use our trademarks.

8. Third-Party Services

The Service integrates with third-party services including Supabase (database and authentication) and sports data providers. These services are governed by their own terms and privacy policies. We are not responsible for the availability or accuracy of third-party data, including sports fixtures, scores, and results.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Sports data, scores, and fixture information are provided for entertainment purposes and may not always be accurate or up to date.

Pundit is not affiliated with, endorsed by, or connected to any sports league, team, governing body, or broadcaster. All league and team names referenced in the app are used for identification purposes only.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Pundit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or any other losses arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Service. You may delete your account at any time by contacting us at support@punditapp.uk.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property, disclaimers, and limitation of liability.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you should stop using the Service.
